1. Acceptance of Terms
By accessing or using any part of The Human Design System platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you may not access or use the Service.
The Service is operated by ICONIC Human Design Education PMA ("ICONIC," "we," "us," or "our"), a private membership association operating under common law. These Terms constitute a binding agreement between you and ICONIC.
By creating an account, purchasing a subscription, or otherwise accessing the Service, you affirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.
2. PMA Structure & Membership
ICONIC Human Design Education PMA is structured as a Private Membership Association. Access to in-depth educational content, courses, readings, and membership services requires accepting the Member Agreement presented during account creation.
Your membership in the PMA is personal and non-transferable. Membership confers no ownership interest in ICONIC, its intellectual property, or its assets.
Public-facing content on this website is educational in nature and does not constitute medical, psychological, or therapeutic advice. Human Design is an educational framework; results and interpretations are for informational purposes only.
3. Account Creation
To access certain features of the Service, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must promptly notify us of any unauthorized use of your account. ICONIC will not be liable for any loss or damage arising from your failure to protect your account credentials.
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Subscriptions & Billing
4.1 Recurring Billing
Certain features of the Service are offered on a subscription basis. By subscribing, you authorize ICONIC (through our payment processor, Stripe) to charge your payment method on a recurring basis at the frequency stated at the time of purchase (monthly or annually).
Your subscription automatically renews at the end of each billing period unless you cancel prior to the renewal date. Subscription fees are charged at the beginning of each billing cycle.
4.2 Price Changes
ICONIC reserves the right to modify subscription pricing at any time. We will provide at least 30 days' advance notice of any price changes via email to your registered address. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.
4.3 Free Trials
If you begin a free trial, your payment method will be charged at the end of the trial period unless you cancel before the trial expires. You may only benefit from one free trial per account.
4.4 Payment Processing
All payments are processed securely through Stripe, Inc. By submitting payment information, you authorize Stripe to store and process your payment data in accordance with their terms of service. ICONIC does not store full payment card numbers.
5. Refund Policy
All sales are final. ICONIC does not offer refunds on digital access, courses, downloads, or subscription fees. Once access to digital content has been granted, the associated purchase is non-refundable.
Exceptions may be considered in cases of:
- Duplicate billing errors (verified by our billing team)
- Technical failure that prevented access to purchased content (verified and unremedied within 7 days)
To request an exception review, contact us via the web form at thehumandesignsystem.com/contact within 14 days of the charge. Refund determinations are made at ICONIC's sole discretion.
Cancelling your subscription stops future charges but does not entitle you to a refund for the current or any prior billing period. You retain access through the end of the paid period.
6. Content & Intellectual Property
6.1 Our Content
All content available through the Service — including courses, articles, audio recordings, videos, charts, software, designs, and written materials — is owned by or licensed to ICONIC Human Design Education PMA and is protected by applicable intellectual property laws. All rights reserved.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service's content for your own personal, non-commercial education. You may not:
- Copy, reproduce, distribute, or publicly display Service content without written permission
- Create derivative works from Service content for commercial purposes
- Share your account credentials to give others access to paid content
- Scrape, data-mine, or systematically extract content from the Service
6.2 Your Content
Content you submit to the Service (community posts, comments, uploaded materials) remains your property. By submitting content, you grant ICONIC a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content in connection with providing the Service. You warrant that you have the right to grant this license and that your content does not infringe third-party rights.
6.3 Birth Data
Birth data (date, time, and place of birth) you provide for chart generation is processed solely to generate your Human Design BodyGraph chart. This data is not sold or shared with third parties for marketing purposes. See our Privacy Policy for full details.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable federal, state, or local law or regulation
- Harass, abuse, threaten, or intimidate other members or ICONIC staff
- Upload or transmit malware, viruses, or malicious code
- Impersonate any person or entity, or falsely represent your affiliation
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use automated tools or bots to access or scrape the Service
- Post content that is defamatory, obscene, fraudulent, or otherwise objectionable
- Use the Service for any commercial purpose not expressly authorized by ICONIC
ICONIC reserves the right to investigate violations of this section and may, at its discretion, suspend or permanently terminate access for violating users without refund.
8. Your Data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
9. Limitation of Liability
9.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ICONIC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ICONIC does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
9.2 Limitation on Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, ICONIC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ICONIC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
9.3 Indemnification
You agree to defend, indemnify, and hold harmless ICONIC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
10. Termination
You may cancel your account and membership at any time by visiting your account settings or by contacting us via the web form. Cancellation takes effect at the end of your current paid billing period.
ICONIC may terminate or suspend your account immediately, without prior notice or liability, for any breach of these Terms or for any other reason at ICONIC's sole discretion. Upon termination, your right to use the Service ceases immediately.
Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and governing law — shall survive.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
You waive any right to a jury trial in connection with any claim arising from or related to these Terms or the Service.
Any claim must be brought within one (1) year of the date it arises, or be forever barred.
12. Changes to These Terms
ICONIC reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date, and by sending a notice to your registered email address at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.
